By accessing and using this website, the user is accepting the TERMS AND CONDITIONS OF USE contained in this agreement and expressly declares their acceptance using electronic means, in accordance with the provisions of Article 1803 of the Federal Civil Code. If the user does not fully and completely accept the terms and conditions of this agreement, they must refrain from accessing, using, and observing the website www.santamonicamx.com. If the user accesses, uses, and observes the website www.santamonicamx.com, it will be considered an absolute and express acceptance of the TERMS AND CONDITIONS OF USE stated here. The mere use of this website grants the general public the status of user (hereinafter referred to as "user" or "users") and implies the full and unconditional acceptance of each and every general and specific condition included in these TERMS AND CONDITIONS OF USE published by SANTA MONICA Joyería Artesanal® at the time the user accesses the website. Any modification to these TERMS AND CONDITIONS OF USE will be made when the owner of the website, in this case SANTA MONICA Joyería Artesanal®, deems it appropriate, and it is the sole responsibility of the user to ensure awareness of such modifications.

By doing so, the user agrees to periodically review the agreement in order to stay informed of such modifications. However, each time the user accesses the mentioned website, it will be considered an absolute acceptance of the modifications to this agreement.

 

Additional Terms

Occasionally, SANTA MONICA Artisan Jewelry® may add additional provisions related to specific areas or new services provided on or through the website www.santamonicamx.com (hereinafter "additional terms"), which will be published in the specific areas or new services of said site for reading and acceptance. The user acknowledges and agrees that these additional terms are an integral part of this agreement for all legal purposes.

 

Assignment of Rights

SANTA MONICA Artisan Jewelry® may, at any time and at its sole discretion, assign all or part of its rights and obligations arising from this agreement. As a result of such assignment, SANTA MONICA Artisan Jewelry® will be released from any obligation in favor of the user established in this agreement.

 

Indemnification

The user agrees to indemnify SANTA MONICA Artisan Jewelry®, its affiliates, suppliers, vendors, and advisors for any action, demand, or claim (including attorney's fees and court costs) arising from any breach by the user of this agreement, including, without limitation, those arising from: a) Any aspect related to the use of the website www.santamonicamx.com. b) The information contained or available on or through said site or any defamatory, libelous, or other conduct in violation of this agreement by the user in the use of the mentioned website. c) Violation of applicable laws or international treaties regarding copyright or intellectual property, contained or available on or through said website.

 

Termination

SANTA MONICA Artisan Jewelry® reserves the right, at its sole discretion and without notice or notification to the user, to: a) Terminate this agreement permanently. b) Discontinue or permanently cease publishing the website www.santamonicamx.com without any liability to SANTA MONICA Artisan Jewelry®, its affiliates, or suppliers.

 

Survival

 

These TERMS AND CONDITIONS OF USE, as well as the additional terms, constitute the entire agreement between the parties and supersede any other agreement or covenant entered into prior to this. Any clause or provision of this agreement, as well as the additional terms, which is legally declared invalid, shall be deleted or modified at the choice of SANTA MONICA Joyería Artesanal®, in order to correct its defect or flaw. However, the remaining clauses or provisions shall retain their force, enforceability, and validity.

 

Non-waiver of Rights

 

The inactivity on the part of SANTA MONICA Joyería Artesanal®, its affiliates, or providers in exercising any right or action derived from this agreement shall not be interpreted at any time as a waiver of such rights or actions.

 

Applicable Law and Jurisdiction

 

This agreement shall be subject to and interpreted in accordance with the laws and before the courts of Mérida, Yucatán, Mexico.

 

General Terms:

 

-The weight of the mountings is approximate and may vary by up to 1 gram.

 

-The time to file a claim for a manufacturing defect in your product is 30 calendar days from the day of purchase.

 

-We reserve the right to cancel your order in case of a pricing error.

 

SANTA MONICA Joyería Artesanal® periodically publishes merchandise offering certain prices. These prices correspond to unique pieces, and since they are unique, SANTA MONICA Joyería Artesanal ® does not commit to replicating them. Therefore, once such an article is sold, the offer (with respect to the price) becomes void. Given this characteristic of the publication, SANTA MONICA Joyería Artesanal ® is not obligated under any circumstances to offer another piece at the same price, as the pieces are unique.

 

SANTA MONICA Joyería Artesanal ® reserves the right to change, WITHOUT PRIOR NOTICE AND FOR ANY REASON THAT IS CONVENIENT TO SANTA MONICA Joyería Artesanal ®, the prices of any published item, whether due to a quotation error or the expiration of a promotion at a certain time or for any other reason. This change can be communicated through various means of communication, including print, electronic, email, radio, television, website www.santamonicamx.com, and any internet platform such as search engines or social media networks, including but not limited to Facebook, Google, Yahoo, Google+, Twitter, YouTube, Pinterest, Instagram, etc. This condition is not limited to the aforementioned platforms, and it includes any other means of communication that currently exist or may exist in the future.

 

Delivery Times: All orders go through a processing time, which can range from 4 to 9 business days. If a specific delivery time is required, it can be requested from the seller and is subject to the availability of the piece and internal logistics. The delivery times provided by sellers or through information on the website www.santamonicamx.com, via telephone, email, verbal communication, or any other form of communication are approximate and may vary. We recommend that customers make their purchase with sufficient time to account for any delays.

 

Shipping Condition for Orders with Credit and Debit Card Charges processed by phone, website, email, chat, or any other form of communication:

 

If payment is made with a credit card, there are only two delivery options:

Pick Up: The customer personally picks up the piece at the corporate office located at Calle 13 #90, between 16 and 18, Colonia Yucatán, Mérida, Yucatán, ZIP code 97050. Upon picking up the item, the customer must present a valid official identification such as an INE/IFE (National Electoral Institute) card or a passport (a driver's license is not valid as identification) and present the card used for payment.

 

Home Delivery: In the case of payment with a credit or debit card and if the customer requires the piece to be shipped to their home, the customer understands that the item can only be shipped to the same address registered as the billing and shipping address in their user account on the website www.santamonicamx.com (the accuracy and updating of the shipping address are and will remain the responsibility of the user). If the customer is unaware of this policy and decides to cancel the order, SANTA MONICA Joyería Artesanal® will charge 10% of the total purchase amount for administrative expenses. The customer must also provide the following information and choose one of the two options:

Option 1:

 

Copy/Photo/Scanned image of the credit or debit card used for the purchase

Copy/Photo/Scanned image of a valid official identification, such as IFE/INE (both sides) or passport (personal data section)

 

Option 2:

 

Copy/Photo/Scanned image of the bank statement for the card used for the transaction, dated no more than 3 months from the date of purchase.

 

IMPORTANT: The method of sending the requested information will be described in the Credit or Debit Card Charge Acceptance Requirements Sheet, which will be sent to the customer via email or any preferred contact method, outlining the instructions for sending the information. Please do not send any additional information beyond what is requested, SANTA MONICA Joyería Artesanal®.

 

The "ocurre" service is NOT available for orders paid with a credit or debit card. Customers requiring the "ocurre" service will need to pay via deposit or bank transfer. Payments made with PayPal® will also allow for the "ocurre" service, provided that it is specified in the delivery address, where the customer must locate the address of the chosen courier and enter it in the designated information space. Changes in the delivery location cannot be made once it has been indicated to the PayPal service.

This does not apply to orders settled with a credit card swiped on the physical terminal at the corporate office with the same address mentioned above in the same clause.

 

Advances:

27.1- When a customer makes an advance payment, the customer commits to paying the remaining 100% of the order. The minimum advance payment must be 20% of the purchase order value.

27.2- The customer has 30 calendar days from the date of the advance payment to settle their order. If the customer does not settle their order within the 30 calendar days, a monthly fee of 10% of the order value will be charged for safekeeping. In other words, if the order is not settled by day 31, an additional 10% of the total order value will be charged, and if the order is not settled by day 60, the order will be canceled and the deposit will be forfeited.

27.3- The maximum time to settle an order is 60 calendar days. If the customer does not settle the order within the 60 calendar days from the day of the initial payment, the order will be canceled, and the deposited/advanced amount will be lost by the customer. Reason: We create personalized pieces that incur administrative and storage expenses, and personalized pieces incur non-reversible expenses. SANTA MONICA Joyería Artesanal® understands that there may be force majeure circumstances for its customers that prevent them from settling these acquired commitments, so an additional grace period of 15 calendar days will be granted, starting from day 61. However, the customer must notify it to the email servicioalcliente@santamonicamx.com or the phone numbers (99) 9271 0351 with a notice of 5 days in advance of day 60 in order to validate the grace period. After the grace period, on day 75, the customer cannot claim their advance payment, and SANTA MONICA Joyería Artesanal® will disclaim any responsibility generated by it.

27.4- If the customer makes an advance payment lower than 20% of the order value, they will have 15 calendar days to complete the 20% minimum advance payment. If the customer does not complete the minimum 20% advance payment within that time, the order will be canceled without the option of a refund. The deposited amount cannot be used as an advance payment for future orders either. If the customer completes the 20% within the 15 calendar days from the initial payment, clause 27.4 no longer applies, and the customer commits to complying with the timelines described in clauses 27.1, 27.2, & 27.3.

 

Deferred Charges.

 

• The calculation presented on the portal for deferred charges is an approximate calculation. It does not represent the exact percentage, as it may vary for each transaction. If you wish to know the exact amount before making the charge, please contact a representative at the customer service center to obtain the exact calculation.
• The percentage for the charges represents the amount before taxes (IVA). At the time of the charge, the VAT will be added to the charged amount for financing.

 

Promotions for "Interest-Free Installments":

 

The customer is aware that these promotions are based on purchases made with credit cards issued by banking institutions such as VISA, MasterCard, or American Express. SANTA MONICA Joyería Artesanal® does not offer direct credit to any customer at any time. All promotions presented on the website, or that may be offered, are subject to prior authorization of credit from the banking institution that issues the credit card. SANTA MONICA Joyería Artesanal® is not obligated to obtain credit for the customer nor does it have any responsibility if the customer's banking institution denies credit for any reason. Therefore, SANTA MONICA Joyería Artesanal® is not liable for any credit denial related to purchases made on www.santamonicamx.com and SANTA MONICA Joyería Artesanal® physical store. If the corresponding authorization from the credit card issuing bank cannot be obtained successfully, the purchase will have to be canceled (unless the customer provides an alternative payment method such as another credit card, debit card, cash, bank deposit, or bank transfer). By accepting the "Terms and Conditions" (by checking the box "I accept the terms and conditions" before clicking "Buy"), the customer acknowledges and understands all the aforementioned details. The Terms and Conditions described herein also apply to purchases made by telephone, in physical stores, via email, WhatsApp, and/or any other contact method provided by SANTA MONICA Joyería Artesanal®. The promotion is valid for orders generated from the start date of the promotion. For orders generated prior to the start date of the promotion, a new order would be required for the promotion to apply. In the case of an order generated before the start of the promotion with a partial payment (anticipo), the remaining balance of that order cannot benefit from the promotion. The full payment must be made, and if deferred payment is desired, the corresponding fee applies.

 

SANTA MONICA Joyería Artesanal® periodically offers its customers special offers with specific validity. It reserves the right to offer promotions with discounts, prizes, or the provision of items or services upon the purchase of a specific item in the promotion. SANTA MONICA Joyería Artesanal® clarifies in this clause that for any purchase order made prior to (regardless of the time period), SANTA MONICA Joyería Artesanal® will not provide any refunds to customers who made their purchase outside the promotion period. Therefore, sales made prior to any promotion cannot be canceled or refunded. Likewise, once the promotion concludes, SANTA MONICA Joyería Artesanal® will not honor any promotion after its conclusion.

 

Interpretation and Compliance

 

The customer/visitor is aware that, for all matters related to the interpretation and compliance of this contract and/or purchase, the parties expressly submit to the jurisdiction and laws of Yucatán, Mexico, hereby waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.

 

Anti-Money Laundering Law

 

SANTA MONICA Joyería Artesanal® is a duly established company in accordance with Federal, State, and Local laws and fully complies with all tax obligations and laws that govern us. Due to this, and in compliance with the new FEDERAL LAW FOR THE PREVENTION AND IDENTIFICATION OF OPERATIONS WITH ILLICIT PROVENANCE RESOURCES, which came into effect in July 2013, all our sales exceeding $50,000.00 Mexican Pesos (paid in cash and/or deposits) will be subject to the compliance with the obligations established by said Law. This Law requires us to request the necessary documentation for the full compliance with the aforementioned Law. Please open the following link that will show you the referenced Law: LINK. THE DELIVERY OF THE MERCHANDISE WILL BE CONDITIONED UPON THE RECEIPT OF ALL THE REQUIRED DOCUMENTATION (BY THE CUSTOMER AND THE COMPANY) ACCORDING TO SAID LAW.

• Copy of the Company's Articles of Incorporation

• Proof of Address of the Company (not more than 3 months old).

 

RETURNS AND EXCHANGES

SANTA MONICA Joyería Artesanal® does not offer money refunds. In case of dissatisfaction due to the quality of the received product, the customer must meet the following condition:

 

• The original item must be in good condition (without signs of use).
• The new item must have a minimum value of 1.3 times the original item, meaning if an original purchase is made for an item worth $1,000.00 MXN, the new item must cost $1,300.00 MXN on the day of the new purchase (If the user enjoys a promotion on the day of the initial purchase that ends before the new purchase is made, SANTA MONICA Joyería Artesanal ® is not obliged to honor that promotion, and the user must pay the list price and/or the price published on the website www.santamonicamx.com).
• The certificate (if applicable) must be returned in good condition.
• The item must have the original engraving of the product (brand logo and/or manufacturer's logo).
• Any item other than diamonds can be exchanged within the first 30 calendar days from the date of purchase, provided that the item can be restored to 100% at the discretion of SANTA MONICA Joyería Artesanal®. If SANTA MONICA Joyería Artesanal® determines that the item cannot be restored, we reserve the right to deny the exchange.
• All decisions regarding exchanges and adjustments will be made based on the terms and conditions, overriding any comments made by any employee of SANTA MONICA Joyería Artesanal® prior to the authorization of the exchange and/or adjustment by an expert authorized by SANTA MONICA Joyería Artesanal®, whether verbal or written.
• Ultimately, SANTA MONICA Joyería Artesanal® reserves the right to refund the money in the same way it was initially paid, and this refund will be subject to a 15% Administrative Fee (which will be non-appealable in any case).
• In the case of exchanges involving natural diamonds, due to the nature of the product, it will be sent for review to confirm that the piece is original and identical to the one delivered. In this case, SANTA MONICA Joyería Artesanal® reserves the right to only make changes in size if it considers that the piece has been altered and/or modified in any of its parts.

 

WARRANTY COVERAGE

 

The products marketed through the website www.santamonicamx.com, as well as through any of the sales channels of SANTA MONICA Artisan Jewelry®, are guaranteed under the following conditions:

 

• Fallen or broken gemstones: These are guaranteed for a period of 30 days from the date of purchase.
• Carat weight: A lifetime warranty is provided; however, certain requirements must be met to validate the warranty: a) Present the original sales receipt, b) Present the product without any modifications or signs of alteration, c) Refunds will be made through bank deposit or interbank transfer for out-of-town customers, or in cash at the SANTA MONICA Artisan Jewelry® headquarters. The refund amount will be based on the weight of the product and the current Gold quotation for 10, 14, or 18K on the day of the refund, d) For carat weight warranty, the customer must provide a carat weight analysis performed by an authorized laboratory for such purposes. This analysis can be requested from any SANTA MONICA Artisan Jewelry® agent. If the customer cannot access a laboratory due to geographic reasons, the customer must send the product to the SANTA MONICA Artisan Jewelry® headquarters, bearing the logistical expenses and paying a fee of $150.00 MXN for the laboratory service. This fee must be paid through bank deposit or transfer before initiating the procedure. In consideration of customer convenience, SANTA MONICA Artisan Jewelry® will provide the customer with the analysis results. If the product fails to meet the carat weight requirements specified by NOM-033-SCFI-1994, SANTA MONICA Artisan Jewelry® agrees to pay the cost of the item as stipulated in point c) of this paragraph, plus a bonus to cover the logistical services, up to a maximum limit of $150.00 MXN including VAT. If the product meets the carat weight standards established by NOM-033-SCFI-1994, SANTA MONICA Artisan Jewelry® will return the product to its origin, provided that the customer covers the current shipping costs, which will be published on the website www.santamonicamx.com and include a maximum insurance amount covered by the courier company in any case.
• Size exchanges are not covered under the product warranty. Please note that sizes may vary if measured with unauthorized measuring instruments other than those authorized by SANTA MONICA Artisan Jewelry®. If there is a difference of more than half a size, the customer must return the product to the headquarters where it will be determined whether there is indeed such a difference from the originally placed order. If the customer initially made an error when capturing and/or communicating the size in their order, they may exchange it provided that no more than 12 hours have passed since the order was placed. If SANTA MONICA Artisan Jewelry® has already incurred expenses due to immediate processing, it reserves the right to charge for the costs associated with the exchange, not exceeding 10% of the total product price, as long as it falls within the standard sizes considered from size 4 to 9 in US measurements.
• Platinum-plated Products: For enhanced contrast and aesthetics, our Yellow Gold and Rose Gold products can be partially platinum-plated. White Gold products, regardless of the carat, are fully platinum-plated to achieve a pure white color. This is because White Gold is a combination of naturally yellow gold and white alloy metals, resulting in a metal color with yellowish tones. After a few months of use, the platinum plating will fade, revealing the original color of White Gold. Platinum-plating, also known as rhodium plating, is a process in which the pieces are coated with a layer of rhodium through electroplating. Rhodium is a white-colored metal used in jewelry, specifically for plating white gold or partially plating Rose Gold and Yellow Gold. Typically, white gold is electroplated with an external layer of rhodium with a thickness ranging from 0.05 to 0.5 micrometers. Black Gold pieces in any category undergo the same platinum-plating process, but in this case, black rhodium is used. Once the pieces are exposed to use, along with friction and contamination from daily use liquids and/or chemicals, the piece may develop a yellowish hue. SANTA MONICA Artisanal Jewelry® always strives to offer the best prices for maintenance services on pieces manufactured by the company. • SANTA MONICA Artisanal Jewelry® declares itself as a company whose suppliers comply with the requirements mentioned in NOM-033-SCFI-1994. Furthermore, SANTA MONICA Artisanal Jewelry® only commits to covering the warranties described in the paragraph on SCOPE OF OFFERED WARRANTIES - Carat Weight.

 

ADJUSTMENTS ON ALREADY DELIVERED ORDERS:

If the customer wishes to make a size change smaller than the originally delivered size on a mount/engagement ring with side stones after the initial product delivery, the customer will have to wait for the necessary time for the ring to be crafted in the new size. The following conditions apply:

 

• The ring to be returned by the customer (the originally delivered one) must be in perfect condition.
• Only a ring of the same model can be exchanged.
• The customer must pay for the restoration of the original ring in case of damages. $450.00 MXN
• The maximum time frame for size changes on rings/mounts with side stones and/or center stones to a smaller or larger size is 30 natural days from the initial product delivery.
• The customer is entitled to 1 size change when the ring has side stones and/or a center stone. For the second change, a fee of $450.00 MXN, corresponding to the value of the mount, will be charged (as long as it corresponds to a change to a standard size, considered from size 4 to 9 in the American scale). Otherwise, the customer must pay an additional cost of 10% on top of the item's value.

 

THE COST OF SIZE CHANGE FOR WEDDING RINGS PRE & POST-DELIVERY IS:

• Restoration of the original ring - $450 MXN (per piece)
• Engraving on the new ring - $450.00 MXN
• In the case of post-delivery: Paying shipping costs - $290.00 MXN PER SEGMENT (SHIPPING TO CORPORATE FROM THE CUSTOMER $290.00 MXN, RETURN SHIPPING FROM CORPORATE TO THE CUSTOMER $290 MXN), TOTALING $580.00 MXN *Extended Zone cost per segment is $490, TOTALING $980.00 MXN.

 

Failure to deliver by SANTA MONICA Joyería Artesanal® due to force majeure shall be understood as follows:

• Natural disasters
• Inherent delays in shipping
• Package loss (by external shipping company)
• Theft that prevents timely delivery

 

In such cases, the customer must understand the situation and acknowledge that a refund will not be issued.

 

HOWEVER, THE FOLLOWING OPTIONS WILL BE OFFERED:

• Use the same amount from the original purchase towards another item of their liking or choice that is currently in stock, for prompt delivery.
• Wait again for the necessary time to replace the ordered item (or a similar item with equal or better characteristics) to be available.

 

If the package arrives incomplete, the customer has 24 natural hours to report it. Failure to report it immediately will result in us not being responsible for replacing the missing item.

 

In the event that the customer does not require an invoice, please note that a Sales Receipt will still be issued in the name of the order, without itemizing the VAT. This receipt will be kept in our records. However, any order over $50,000 Mexican Pesos must be invoiced, including the customer's RFC (tax ID) and itemizing the VAT (if applicable), along with the documentation required by the law described in the "Anti-Money Laundering Act" clause at the top of the terms and conditions.

 

Extraordinary ring sizes: If the customer requires a ring in a size larger than size 13, they will need to verify if we can produce it. If it can be produced, the customer will have to wait approximately 20 business days for it to be ready. The following charges apply for each extra size:

 

13.5-15: 10% of the product's value based on size 13.

Current promotions can be found on the website: www.santamonicamx.com. If the current promotion is not listed on the aforementioned website, it will not be valid.

 

Once a deposit is received for an order, the order is immediately sent for production. Therefore, we reserve the right to deny changes to the order.

 

When reserving a piece, a period of 60 days is allowed for its release. In the event that there is a price modification for the product in question after 30 days from the initial payment, the customer must cover the new price of the item. There is no possibility to cancel a reservation.

 

Special products, understood as those jewelry pieces that the customer requests to be designed by SANTA MONICA Joyería Artesanal®, in which case said piece should not infringe copyright. SANTA MONICA Joyería Artesanal® is unaware of the total number of pieces protected by intellectual property and/or copyright, therefore the user expressly accepts any liability, claims, royalties, etc. that may arise from the manufacture of such piece, and releases SANTA MONICA Joyería Artesanal® from any liability. The user agrees to pay the total compensation and/or expenses derived from claims or royalties related to such pieces.

 

Delivery Time Guarantees. SANTA MONICA Joyería Artesanal® does not provide full or partial refunds for shipping fees in any case, even if the courier fails to meet the delivery time. In such cases, the user may exercise the guarantee with the chosen logistics provider. SANTA MONICA Joyería Artesanal®, considering the convenience of its customers, may provide assistance in the procedure to obtain such reimbursement. However, SANTA MONICA Joyería Artesanal® is not responsible for the response of the logistics provider, as there may be conditions that prevent them from making the payment of the guarantee.

 

Merchandise Insurance. The shipping costs presented on the website www.santamonicamx.com include a risk premium of $2,200.00 MXN, which should be claimed by the user from the courier in the event of loss, loss or for any reason presented by the courier. SANTA MONICA Joyería Artesanal ®, considering the convenience of its customers, may assist the user by advising on the procedure to follow and the designated customer service channels for such service. The user expressly accepts the premium that covers the shipping service. If the customer wishes to insure the product with a higher premium, they must communicate it via email to atencionalcliente@santamonicamx.com with the order number and pay the corresponding amount through deposit and/or interbank transfer. This amount will not apply to deferred payments and/or interest-free installments in any case.
